ALBUQUERQUE, N.M. – Joshua Gutierrez, 21, of To’Hajilee, Mexico appeared
in federal court in Albuquerque on March 31 for an initial appearance on a
criminal complaint charging him with murder in Indian Country.
According
to the complaint, Gutierrez committed the offense on March 29 in To’Hajilee,
New Mexico on the Navajo Nation. Gutierrez allegedly shot the victim in the
chest with a pistol. The victim later died from his injuries. The FBI arrested
Gutierrez at his home later in the day. He is currently in custody pending a
detention hearing scheduled for April 2. A complaint is only an accusation. A
defendant is presumed innocent until proven guilty.
The FBI
investigated this case with the assistance of the Navajo Nation Department of
Public Safety. Assistant U.S. Attorney Allison Jaros is prosecuting the case.
