SACRAMENTO—Bryce Wayne Nicholes, 23, of Marysville, was arraigned today after his arrest on drug charges United States Attorney Benjamin B. Wagner and Federal Bureau of Investigation Special Agent in Charge Herbert Brown announced. A federal grand jury returned an indictment against him on April 5, 2012. Nicholes delayed an entry of plea until a detention hearing on April 13, 2012.
According to the indictment, on March 1, 2012, Nicholes possessed methamphetamine and cocaine base (also known as crack cocaine) with intent to distribute in Yuba County.
This case is the product of an investigation by the Federal Bureau of Investigation Safe Streets Task Force, the Yuba Sutter Narcotic Enforcement Team-NET 5, and the Yuba City Police Department. Assistant United States Attorney Jill Thomas is prosecuting the case.
If convicted of the methamphetamine offense, Nichols faces a term of 10 years to life in prison and a $10 million fine. The cocaine drug offense carries a statutory maximum prison term of 20 years and a $1 million fine. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.
The charges are only allegations, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.
