United States Attorney Ron Parsons announced that a Rosebud,
South Dakota, man convicted of Assaulting, Resisting, and Impeding a Federal
Officer was sentenced on October 7, 2019, by U.S. District Judge Roberto A.
Lange.
Michael Anthony Toledo, age 39, was sentenced to 4 months in
federal prison, followed by 4 months home confinement, 2 years of supervised
release, and a special assessment to the Federal Crime Victims Fund in the
amount of $100.
Toledo was indicted by a federal grand jury on March 12, 2019. He pled guilty on July 22, 2019.
The conviction stemmed from an incident that occurred on
April 18, 2017, when Toledo did forcibly assault and interfere with a law
enforcement officer who was employed by the Rosebud Sioux Tribe Law Enforcement
Services, when Toledo repeatedly spat upon the officer while being arrested.
This case was investigated by the Federal Bureau of
Investigation. Assistant U.S. Attorney
Michael J. Elmore prosecuted the case.
Toledo was immediately turned over to the custody of the
U.S. Marshals Service.
