BUFFALO, N.Y. - U.S. Attorney James P. Kennedy, Jr.
announced today that Donald Egan, 51, of Buffalo, NY, pleaded guilty to
possession of child pornography before U.S. District Judge Richard J. Arcara.
The charge carries a minimum penalty of 10 years in prison, a maximum of 20
years and a $250,000 fine.
Assistant U.S. Attorney Jonathan Cantil, who is handling the
case, stated that on July 19, 2017, a United States Probation Officer seized a
cellular telephone from the defendant during a routine supervision visit at his
Memorial Drive residence in Buffalo. At the time, Egan was a sex offender under
supervision and possession of a phone was a violation of the defendant’s
release from prison.
The officer turned the phone over to the FBI’s Child
Exploitation Task Force which led to the discovery of 32 images of child
pornography. Some of the images included pre-pubescent minors.
The plea is the result of an investigation by the United
States Probation Department, under the direction of Chief Probation Officer
Anthony SanGiacomo, and the Federal Bureau of Investigation, Buffalo Division,
under the direction of Special Agent-in-Charge Gary Loeffert.
.
Sentencing is scheduled for August 22, 2018, at 12:30 PM
before Judge Arcara.
