May 20, 2010 - Michael Robert Hoaglen, 49, of Boise, Idaho, was sentenced yesterday to 295 months in federal prison for conspiracy to distribute methamphetamine and possession of a firearm in furtherance of a drug trafficking crime, the United States Attorney’s Office announced. U.S. District Judge Edward J. Lodge also order Hoaglen to serve five years supervised release following his prison term, and required him to pay a $2000 fine. Hoaglen had entered a guilty plea to the charges in February 2010.
Hoaglen was arrested after selling one pound of methamphetamine to an undercover officer in the Lowe’s parking lot on Overland Road. When police attempted to arrest him, Hoaglen reached for a loaded pistol that he had in his waistband. An undercover officer shoved him into his vehicle and the firearm fell from his waistband. Hoaglen is four time convicted felon, who had previously been convicted of Forcible Rape, Felony Domestic Battery, Grand Theft and Failure to Register as a Sex Offender.
Hoaglen was sentenced to 235 months for the distribution of methamphetamine, but because he possessed a firearm in furtherance of a drug trafficking crime, federal law requires atleast five additional years of prison to run consecutive to all other punishment. There is no parole in federal court, so the defendant will serve the entire sentence in a federal prison.
The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Boise Police Department.
