United States Attorney Ron Parsons announced that a Wagner,
South Dakota, man convicted of Aggravated Sexual Abuse was sentenced on June 6,
2019, by U.S. District Judge Karen E. Schreier.
Xavier Zephier, age 26, was found guilty of Aggravated
Sexual Abuse as a result of a federal jury trial in Sioux Falls, South Dakota,
on March 5, 2019. Zephier was sentenced
to 180 months in federal prison, followed by 5 years of supervised release, and
a special assessment to the Federal Crime Victims Fund in the amount of $5,100.
The conviction stemmed from an incident on October 29, 2017,
when Zephier forcibly raped a woman while she was sleeping.
This case was investigated by the Federal Bureau of
Investigation. Assistant U.S. Attorneys
Jennifer D. Mammenga and Ann M. Hoffman prosecuted the case.
Zephier was immediately turned over to the custody of the
U.S. Marshals Service.
