February 16, 2010 - Acting United States Attorney Robert S. Cessar announced today, February 12, 2010, that Christopher Franc, d/b/a C.A. Franc Construction, a resident of Valencia, Pennsylvania, pleaded guilty in federal court to a charge of willful violation of an Occupational Safety and Health Administration (OSHA) regulation causing the death of an employee.
Franc, 44, pleaded guilty to one count before Chief United States District Judge Gary L. Lancaster.
In connection with the guilty plea, Assistant United States Attorney Nelson P. Cohen advised the court that Franc willfully failed to utilize safety equipment required by OSHA regulations designed to protect employees working on steep roofs. As a result, one of Franc's employees, identified as CB in the information, fell to his death on August 15, 2009, in Washington County, Pennsylvania.
Chief Judge Lancaster scheduled sentencing for June 18, 2010 at 1:30 p.m. The law provides for a total sentence of six months in prison, a fine of $250,000, and a term of supervised release of one year. The actual sentence imposed is based upon the seriousness of the offense and the criminal history, if any, of the defendant.
The Occupational Safety and Health Administration and the Federal Bureau of Investigation conducted the investigation that led to the prosecution of Christopher Franc, d/b/a C.A. Franc Construction.
