February 16, 2010 - Nora R. Dannehy, United States Attorney for the District of Connecticut, and Kimberly K. Mertz, Special Agent in Charge of the Federal Bureau of Investigation in New Haven, today announced that a federal grand jury sitting in New Haven has returned a four-count indictment charging RICHARD PASCONE, also known as “S,” 55, of Milford, with the illegal sale of oxycodone and a handgun that had an obliterated serial number.
The indictment alleges that on two occasions in November 2009, PASCONE illegally distributed oxycodone. The indictment further alleges that, on January 29, 2010, PASCONE sold an Astra A-60 semi-automatic pistol with an obliterated serial number to a convicted felon.
The indictment was returned under seal yesterday, February 11. PASCONE was arrested this afternoon at a location in Derby. He appeared before United States Magistrate Judge Holly B. Fitzsimmons in Bridgeport and is detained pending a detention hearing that is scheduled for February 18.
If convicted, PASCONE faces a maximum term of imprisonment of 20 years and a fine of up to $1 million on each of the two oxycodone distribution charges, and a maximum term of imprisonment of five years and a fine of up to $250,000 on each of the two firearms charges.
U.S. Attorney Dannehy stressed that an indictment is only a charge and is not evidence of guilt. The defendant is entitled to a fair trial at which it is the Government’s burden to prove guilt beyond a reasonable doubt.
This matter is being investigated by the Federal Bureau of Investigation’s Fairfield County Organized Crime Task Force, which includes the Stamford and Bridgeport Police Departments. The case is being prosecuted by Assistant United States Attorney Ray Miller.
