U.S. Marshals Capture Sexual Assault Fugitive Wanted Since 2009

Charges stem from incidents in Monroe County

February 16, 2010 - Scranton, PA – U.S. Marshal Michael R. Regan announced today that the U.S. Marshals Service (USMS) arrested Eric Daniel Martinborough, Jr. in Scranton, Pennsylvania.

Martinborough was being sought on an arrest warrant, dated May 28, 2009, and signed by Magisterial District Judge Anthony D. Fluegel in Tobyhanna, Pennsylvania.

In April 2009, the Pocono Mountain Regional Police Department conducted an investigation into alleged sexual assaults of a minor in Tobyhanna. The assaults allegedly began in 2005 when the victim was 13 years old. As a result, an arrest warrant was issued against Martinborough, charging him with the following offenses:

48 counts of Involuntary Deviate Sexual Intercourse

24 counts of Aggravated Indecent Assault

1 count of Unlawful Contact with a Minor

1 count of Corruption of Minors

1 count of Endangering the Welfare of Children

1 count of Dissemination of Obscene/Sexual Materials to a Minor

On January 26, 2010, the Pocono Mountain Regional Police Department requested the assistance of the U.S. Marshals Service to locate and apprehend Martinborough. This fugitive case was adopted by the U.S. Marshals Service’s Fugitive Task Force in the Middle District of Pennsylvania.

On February 11, U.S. Marshals in Scranton investigated leads in several sections of Scranton. During the early afternoon hours, U.S. Marshals located and arrested Martinborough at a house in 500 block of Kennedy Street. The fugitive was taken into custody without incident.

Martinborough, 39 years of age, waived arraignment in Lackawanna County. He was turned over to the Pocono Mountain Regional Police Department for processing and court proceedings in Monroe County.
