Mission Man Pleads Guilty to Sexual Abuse

U.S. Attorney Brendan V. Johnson announced that Chester Dennis Marshall, a/k/a Dennis C. Marshall, age 45, of Mission, appeared before U.S. District Judge Roberto A. Lange on May 24, 2011, and pled guilty to count two of the indictment that charged him with sexual abuse. The maximum penalty upon conviction is any term of years or life imprisonment.

During the evening hours of September 10, 2010, and into the early morning hours of September 11, 2010, the victim was visiting at the home of her mother and Marshall. The victim had consumed alcohol and decided to spend the night. Early the next morning, the victim awoke with the defendant attempting to engage in a sexual act with her, while she was incapable of appraising the nature of the conduct and physically incapable of declining participation in and communicating unwillingness to engage in the sexual act.

The investigation was conducted by the Federal Bureau of Investigation. The case is being prosecuted by Assistant U.S. Attorney Meghan N. Dilges.

A presentence investigation was ordered, and a sentencing date was set for August 15, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
