May 5, 2010 - KANSAS CITY, MO—Beth Phillips, United States Attorney for the Western District of Missouri, announced that a Kansas City, Missouri man was indicted by a federal grand jury today for robbing Commerce Bank at gunpoint.
Derrick T. Hubbard, 20, of Kansas City, was charged in a two-count indictment returned by a federal grand jury in Kansas City. Today’s indictment replaced a federal criminal complaint that was filed against Hubbard on April 23, 2010.
The federal indictment alleges that Hubbard stole $11,253 from Commerce Bank, 4604 Wornall, Kansas City, on April 22, 2010. In addition to the bank robbery, the indictment charges Hubbard with using a firearm during a crime of violence.
According to an affidavit filed in support of the original criminal complaint, Hubbard entered the bank at approximately 2:30 p.m. Hubbard allegedly carried a handgun and ordered a bank employee to take him behind the teller line. When Hubbard and the employee entered the secure teller area, the affidavit says, Hubbard collected money from several teller drawers.
Shortly after the robbery, Kansas City police officer were in the vicinity of the bank doing an area canvass when they spotted Hubbard, who was arrested. Police officers later located $11,253 inside a black backpack in a nearby dumpster. The backpack also contained a loaded handgun.
Phillips cautioned that the charges contained in this indictment are simply accusations, and not evidence of guilt. Evidence supporting the charges must be presented to a federal trial jury, whose duty is to determine guilt or innocence.
This case is being prosecuted by Assistant U.S. Attorney D. Michael Green. It was investigated by the Federal Bureau of Investigation and the Kansas City, Missouri Police Department.
