Drug and Gun Crimes

Five Men Charged with Queen City Drug and Gun Crimes


April 17, 2010 - CONCORD, NH—United States Attorney John P. Kacavas announced that five men have been charged with a variety of conspiracy, drug distribution and gun offenses all committed in Manchester, N.H. The charges announced are as follows:

Luis Alberto Reyes (a.k.a. Javier Roman Dias a.k.a. “Enano”), Angel Andino and Raul Posadas (a.k.a. “Rudy”) were all charged in an indictment unsealed today. The indictment charges all three individuals with conspiring to distribute oxycodone and cocaine from August, 2009 to February 25, 2010. Andino, of Manchester, who was arrested today, is also charged with unlawful possession of a firearm on February 18, 2010. The indictment also includes charges against Reyes, of Methuen, Massachusetts, for distribution of oxycodone on February 19, 2010, and possession of cocaine with intent to distribute, on February 25, 2010. Posadas, of Manchester, is also charged with possession of oxycodone with intent to distribute, possession of cocaine with intent to distribute, and possession of a firearm in furtherance of a drug trafficking offense, all on February 18, 2010.

The drug charges carry maximum prison terms of at least 20 years. The unlawful possession of a firearm charge against Andino carries a maximum prison term of 10 years and the charge against Posadas for possessing a firearm in furtherance of a drug trafficking offense carries a mandatory minimum prison term of five years.

Andino, who was arraigned today before United States Magistrate Judge James R. Muirhead, was detained pending trial, which is scheduled for June 2010. Reyes and Posadas are in custody and are expected to be arraigned shortly.

Jesse Harris, of Manchester, was arraigned today on an indictment charging him with one count of possession of oxycodone with intent to distribute on February 18, 2010. That charge provides for term of imprisonment of up to 20 years. Judge Muirhead ordered Harris detained pending further proceedings and scheduled trial for June 15, 2010.

William Provencher, of Manchester, today was arraigned on an indictment that includes charges that, on February 18, 2010, he possessed oxycodone with intent to distribute, marijuana with intent to distribute, and a firearm in furtherance of a drug trafficking offense. The oxycodone charge can result in imprisonment of up to 20 years and the marijuana charge can result in a prison term of up to five years. The firearm charge carries a mandatory minimum term of five years in prison. The defendant was detained pending a detention hearing on April 21, 2010. Provencher’s trial is scheduled for June 2, 2010.

This matter was investigated by the Manchester Police Department, the New Hampshire Attorney General’s Drug Task Force, the Drug Enforcement Administration, the Bureau of Alcohol Tobacco and Firearms and the Federal Bureau of Investigation. The prosecution is being handled by Assistant U.S. Attorney Bill Morse.

U.S. Attorney Kacavas reminds the public that an indictment merely alleges that a crime has been committed and that all defendants are presumed innocent until proven guilty beyond a reasonable doubt.
